Recent footage from “It Ends With Us” shows Blake Vigorous allegedly improvising a kiss with Justin Baldoni, which his lawyers claim was unscripted.
The clip of the deleted scene comes after the actress sued her co-star for sexual harassment, with a significant allegation that Baldoni improvised sexual scenes that left her feeling uncomfortable.
Blake Vigorous is currently looking for over $160 million for lost earnings, business profits, and reputational harm, plus punitive damages, attorneys’ fees, and emotional distress.

Newly revealed footage from “It Ends With Us” has sparked fresh legal debate, as Baldoni’s attorneys assert that Vigorous improvised a kiss that was not a part of the unique script.
The clip, just over a minute long, was submitted as a part of the Wayfarer parties’ motion for summary judgment filed on November 13. It shows Baldoni and Vigorous, portraying Ryle and Lily, in a hospital scene where a transient kiss occurs.
In accordance with People Magazine, Baldoni’s legal team claimed that Vigorous personally “oversaw” this scene in May 2023, noting that she “added to the script, wherein her character kissed Baldoni’s character in every take, although there was no kiss within the script.”

When “It Ends With Us” was set to resume production in January 2024 after the Hollywood strikes, Vigorous reportedly met with Baldoni and producers with a listing of conditions for returning to work, including a strict rule against improvising any further kisses.
Baldoni’s attorneys now contend that Vigorous’s lawsuit must be dismissed because the newly unveiled hospital scene predates that meeting and shows that Vigorous also partook within the act of improvising kiss scenes, an allegation she used against the director.

Justin Baldoni’s Dismissed $400M Lawsuit Cited Scripted Kisses

In a $400 million suit filed by Baldoni in January, which was later dismissed, his legal team maintained that every one kissing scenes filmed before the strike adhered strictly to the script.
They now claim this hospital scene, shot on May 19, 2023, represents the one instance of an unscripted kiss.
“Vigorous also complains that there was inappropriate and improvised kissing through the first period of filming, before the strike break. Nevertheless, actually, the one two kissing scenes filmed through the initial filming period were each scenes that included kisses as written within the script. These kissing scenes weren’t improvised,” Baldoni’s lawyers wrote within the January 2025 filing.

The case is scheduled to go to trial in March 2026, with each actors expected to testify. On November 13, Baldoni and the Wayfarer parties requested that Judge Lewis J. Liman grant summary judgment, potentially resolving the dispute with out a trial. A ruling has not yet been issued.
Blake Vigorous Seeks $160 Million In Damages, Alleging Retaliation And Reputational Harm

Meanwhile, Vigorous’s legal team claims they possess “extensive evidence” that she faced retaliation, alleging that “negative content about her that was amplified, boosted, perpetuated, planted, and/or otherwise manipulated by the Wayfarer Defendants and the Wallace Parties.”
Baldoni’s attorney, Bryan Freedman, stated on November 4 that the defense is concentrating on Vigorous’s claims and is committed to “pursuing the reality through every legal and factual avenue” in court.
Vigorous is looking for greater than $160 million in damages in reference to the lawsuit.

In a court filing originally submitted in July and unsealed on November 5, she claimed to have suffered substantial financial and reputational losses, including damages from past and future acting work, speaking engagements, producing, appearances, and other ventures.

The damages breakdown includes over $56 million in lost earnings and $71 million in lost business profits, linked to her ventures Betty Buzz, Betty Booze, and Blake Brown Beauty.
Moreover, the filing estimates $34 million in reputational harm, based on roughly 65 million negative impressions about Vigorous circulated on social media.
These figures are preliminary and might be subject to expert verification, through expert testimony, in keeping with the filing.
Beyond financial losses, Vigorous can also be pursuing compensation for punitive damages, attorney’s fees, and emotional distress.
The filing states she has endured “pain and suffering, physical pain, and humiliation,” and claims damages for these harms “within the range of $250,000 to $400,000.”

Blake Vigorous Speaks Out On Personal Toll Of Lawsuit

Vigorous previously spoke publicly concerning the personal toll of the lawsuit in a June 9 Instagram Stories post, following the dismissal of Baldoni’s countersuit.
She wrote, “Like so many others, I’ve felt the pain of a retaliatory lawsuit, including the manufactured shame that tries to interrupt us.” She added, “While the suit against me was defeated, so many haven’t got the resources to fight back.”
The actress further emphasized her commitment to advocacy, stating she is now “more resolved than ever to proceed to face for each woman’s right to have a voice in protecting themselves, including their safety, their integrity, their dignity, and their story.”
