Within the Vijay Thalapathy starrer Jana Nayagan case, the Central Board of Film Certification (CBFC) filed a caveat within the Supreme Court, as reported by Bar and Bench, stating that no orders must be passed until the CBFC is heard. Directed by H Vinoth, Jana Nayagan is believed to be Vijay’s final film before he ventures into politics together with his Tamilaga Vettri Kazhagam (TVK) party.
Vijay Thalapathy Led Jana Nayagan’s Release Might Get Delayed
This development comes amid anticipation that producer KVN Productions may approach the Supreme Court over the Madras High Court Division Bench’s order related to the film, in accordance with Live Law. The High Court had stayed a single judge’s directive to grant Jana Nayagan a UA certificate. On January 27, a Division Bench of the Madras High Court upheld the CBFC’s appeal and put aside the sooner order directing the certification. The film, which was scheduled for release on January 9, was postponed as a result of delays in censor certification. Despite weeks of legal proceedings, the film has yet to receive certification.
What The Madras High Court Directed?
The court examined a criticism filed against Jana Nayagan by a member of the CBFC examining committee. The bench noted that the CBFC must have been given adequate time to present its case throughout the single-judge hearing that originally favored certification. The court also identified that there was no challenge to Chairperson Prasoon Joshi’s order and advised the producer to achieve this while continuing the legal process. The court put aside the single-judge order that directed the CBFC to certify the film and remanded the matter for a fresh review.
What Led To This Situation
The producer claimed that in December, the CBFC’s examining committee viewed the film and indicated it may very well be granted a UA 16+ certificate after 14 cuts. The filmmakers made the obligatory cuts but didn’t receive any further communication from the censor board until January 5, once they approached the Madras High Court. The CBFC argued that certification was delayed as a result of a criticism alleging the film might hurt religious sentiments and that certain scenes required clearance.
A single judge initially directed the CBFC to grant certification. Nevertheless, the censor board appealed and obtained a stay order against this verdict. The Supreme Court declined to listen to the producer’s plea and directed him to hunt relief within the HC. After hearing arguments on January 20, the HC reserved its decision for January 27. After 22 days and multiple court hearings, Jana Nayagan stays uncertified.
