Cher‘s request for immediate conservatorship of her son, Elijah Blue Allman, has been denied by a court after she claimed that he wouldn’t give you the option to administer his funds because of his mental health and history of substance abuse.
The singer wanted a brief conservator to be appointed to administer her son’s estate and help control the cash from his Trust so he doesn’t “spend it on drugs.” Elijah has since revealed his plan to fight his mother’s request for conservatorship.
Cher Denied Immediate Conservatorship Of Son Elijah
In keeping with reports, on Friday, a judge denied famous singer Cher’s request for immediate conservatorship of her 47-year-old son, Elijah Blue Allman.
Judge Jessica A. Uzcategui of the Los Angeles Superior Court reportedly found that Cher’s attorneys had not provided Elijah and his attorneys with the required paperwork to offer them enough time to present their case. The judge has now set a brand new hearing date of January 29.
The ruling comes after Elijah filed an opposition to his mother’s Ex Parte, noting that he was not adequately served papers, which might have given him and his legal counsel enough time to arrange for the January 5 hearing of his conservatorship.
In his filing, obtained by The Blast, Elijah stated that although he received an e-mail a few petition, he disregarded it as he was undecided of the sender’s address. He also claimed that even when he had accepted the e-mail service, the time it was sent was already too near the date of his court hearing.
He said, “While I did receive an e-mail copy of some petition and related documents on December 31, 2023, even when I had accepted service by e-mail that was not five court days before the hearing, and I actually have yet to receive or review the Confidential Supplemental Information that has been filed by [Cher].”
In his second court filing, Elijah noted that he has been “clean and sober from illicit substances for over 90 days now and [is] fully able to and committed to managing the cash [he] receives quarterly from the trust left by [his] late father.”
The musician also stated that he’s aware of his mother’s good intentions, but he doesn’t need her “unsolicited” support.
“While I understand that my mother, the proposed conservator, believes she is searching for my best interests, and I appreciate her love and support, I don’t need her unsolicited help or support presently,” Elijah said.
The Singer Claims Conservatorship Will Help Protect Her Son’s Money
The singer has claimed that her reason for filing a conservatorship was because of her son’s history of substance abuse. Cher emphasized that her son, who’s entitled to a Trust, is unable to administer his own funds and that he would spend it “immediately” on drugs.
Court documents obtained by The Blast read: “[Cher] has been unable to debate Elijah’s preferences regarding the appointment of a brief conservator because given Elijah’s current mental and physical health issues, discussed intimately within the concurrently filed Confidential Supplemental Information, he’s unable to form or express a preference regarding the appointment of a conservator for his estate.”
Her lawsuit on the time stated that she was nervous Elijah would spend his money on drugs because of his ongoing mental health and substance abuse issues.
“[Cher] is worried that any funds distributed to Elijah will immediately be spent on drugs, leaving Elijah with no assets to offer for himself and putting Elijah’s life in danger,” the document continued.
Cher can also be in a legal battle together with her son’s estranged wife, Marieangela King, with whom he recently reconciled. King previously accused the star of blocking her assets, kidnapping her own son, and in addition interfering along with his health management.
