Elvish Yadav Snake Venom Case: SC Quashes FIR, Legal Proceedings

The Supreme Court has dismissed the FIR and all related proceedings against YouTuber Elvish Yadav within the snake venom case filed by Uttar Pradesh Police in 2023 under the Wildlife Protection Act. The bench stated that the case cannot proceed since the criticism was not filed by a licensed person.

The fees under the Indian Penal Code were based on an earlier FIR in Gurugram, which has already been closed. Moreover, the court noted that the NDPS Act doesn’t apply, because the liquid substance found was not a scheduled dr*g.

Referring to previous rulings, the Supreme Court canceled the FIR, chargesheet, and trial court orders against Yadav. The case was registered on November 22, 2023, and Yadav was arrested on March 17, 2024, for allegedly using snake venom at a rave party in Noida. Yadav challenged the Allahabad High Court’s decision to refuse canceling the chargesheet and trial court order, which classified the incident as a serious crime.

On August 6 last 12 months, the Supreme Court had temporarily halted the trial court proceedings. The chargesheet claimed snake venom was used as a recreational dr*g at rave parties attended by foreigners. Yadav’s lawyer argued that no snakes, dr*gs, or illegal substances were found with him. He also stated, there was no connection between him and the co-accused. The lawyer also identified that the informant was not an animal welfare officer. Nonetheless, the complainent had filed the FIR pretending to be one.
