Earlier within the day, Bollywood Hungama<\/strong> reported that Vashu Bhagnani\u2019s Puja Entertainment (India) Ltd, has filed a Rs. 400 crore suit within the Bombay High Court against Suggestions Industries Limited, Ramesh Taurani, Kumar S Taurani and David Dhawan for allegedly using the songs \u2018Chunari Churani<\/em>\u2019 and \u2018Ishq Song Hai<\/em>\u2019 from their film Biwi No. 1<\/em> in Hai Jawani Toh Ishq Hona Hai<\/em>. Now, Puja Entertainment\u2019s lawyer Advocate VK Dubey has spoken in regards to the allegations intimately in a video chat with the news agency ANI.<\/p>\n Puja Entertainment lawyer accuses Suggestions of using songs even after rights were cancelled in 2018<\/span><\/span><\/p>\n The lawyer claimed that Puja Entertainment had withdrawn the audio rights of their songs from Suggestions. \u201cMusic firms buy music rights from producers,\u201d he said. \u201cAs per our earlier agreements with Puja Entertainment with Suggestions, only the audio rights got. In 2018, Suggestions had sent us an email asking also for the visuals rights of the songs. At the moment, Vashu ji replied to them and things didn\u2019t work out. Then Puja Entertainment had sent a notice to them saying that they’re cancelling the agreement as they didn\u2019t comply with the terms related to royalty and other things. So, Puja Entertainment had cancelled all rights at the moment. So, leave alone video rights, Puja Entertainment had even cancelled the audio rights.\u201d<\/p>\n Dubey alleged that Suggestions continued to take advantage of even the visuals of the songs from Puja Entertainment\u2019s movies. \u201cAfter these rights were nullified, they (Suggestions) must have gone to some court,\u201d he said. \u201cYou didn\u2019t go and also you continued to make use of the music. Not only audio, but they continued to stream the songs on YouTube, Instagram and other platforms.\u201d<\/p>\n He added, \u201cAside from Biwi No. 1<\/em>, there are 4-5 more movies like Tera Jadoo Chal Gaya<\/em> and Bade Miyan Chote Miyan<\/em> whose songs Suggestions has been using in an illegal manner. They committed copyright infringement from that day itself once they began streaming the songs on social media because they don\u2019t have the rights. In the event that they are literally the owners of the rights, why aren\u2019t you showing those documents? Come to the court and show them.\u201d<\/p>\n The trailer of Hai Jawani Toh Ishq Hona Hai<\/em> was earlier postponed and the explanation given was a \u2018technical glitch\u2019. Dubey claimed that this wasn\u2019t the actual reason for the postponement. \u201cThey said it’s postponed as a result of a technical glitch. But in point of fact, it was an order by the honourable court to keep up the establishment. They knew that in the event that they had gone ahead with the trailer launch, it might have been a contempt of the establishment.
