Court of Appeal to overturn the May 13 not guilty verdict and order a brand new trial for William Majcher.<\/p>\n<p>The Public Prosecution Service of Canada argued the judge erred when she <a href=\"https:\/\/canlii.ca\/t\/kkx6t\">dismissed the charge<\/a> that Majcher was effectively a Chinese government agent.<\/p>\n<p>The Crown\u2019s application, obtained by Global News, argues the judge failed to think about all of the evidence, assessed it incorrectly and excluded expert evidence.<\/p>\n<p>Ian Donaldson, Majcher\u2019s criminal defence lawyer, confirmed the appeal was filed on Thursday. The prosecution service didn&#8217;t reply to questions sent by email.<\/p>\n<p>Majcher said in an announcement to Global News on Sunday the choice to appeal the case \u201cappears disconnected from each the evidence and the findings of the trial court.\u201d<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below commercial<\/p>\n<\/p><\/div>\n<p>\u201cThe decision confirmed what I even have maintained from the start: I committed no offence \u2013 full stop! The prosecution\u2019s theory against me was rejected by the Supreme Court of British Columbia after a full examination of the facts,\u201d he said.<\/p>\n<p>The civil lawyer representing Majcher said the general public was entitled to ask why the case was continuing given judge found evidence was lacking.<\/p>\n<p>\u201cFrom our perspective, the appeal appears to lack substantive merit and risks becoming an exercise in institutional self-preservation relatively than the pursuit of justice,\u201d Joel Etienne said.<\/p>\n<div class=\"c-inlineSignup\" data-newsletter-inline=\"\">\n<div continues.\u201d<\/p>\n<p>In an exclusive interview with Global News to be published on Tuesday, Majcher responds intimately for the primary time to the Canadian investigation that targeted Beijing\u2019s suspected meddling in every little thing from elections to the humanities.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below commercial<\/p>\n<\/p><\/div>\n<p>However the case became the newest to finish and not using a conviction, following the acquittals of a Canadian Space Agency worker and a <a href=\"https:\/\/canlii.ca\/t\/jlfp7\">federal contractor<\/a> who faced similar charges.<\/p>\n<p>After leaving the RCMP in 2007, Majcher moved to Hong Kong to work in banking and personal security.\u00a0He was arrested upon landing at Vancouver airport in 2023.<\/p>\n<div class=\"c-tabs\">\n<p>\n\t\t\t<button role=\"tab\" class=\"c-tabs__tab c-tabs__tab--active\" type=\"button\">More Integrated National Security Enforcement Team had launched an investigation into\u00a0Majcher\u00a0in 2021.<\/p>\n<p>The statement accused him of using his knowledge and contacts in Canada \u201cto acquire intelligence or services to profit the People\u2019s Republic of China.\u201d<\/p>\n<p>He also \u201ccontributed to the Chinese government\u2019s efforts to discover and intimidate a person outside the scope of Canadian law,\u201d the RCMP claimed.<\/p>\n<p>The arrest got here amid a series of Global News and Globe and Mail reports about government inaction on Beijing\u2019s meddling in Canada\u2019s political and domestic affairs.<\/p>\n<p>But when Majcher\u2019s trial got underway in April, the case had been narrowed to a single\u00a0count under the Security of Information Act, based on one email exchange.<\/p>\n<p>The Crown alleged the messages were about Kevin Sun, a Vancouver resident China had accused of fleeing the country with tens of thousands and thousands of dollars.<\/p>\n<div class=\"c-ad c-ad--bigbox l-article__ad\">\n<p>Story continues below commercial<\/p>\n<\/p><\/div>\n<p>Although prosecutors accused Majcher of a 2017 plot to pressure Sun to return to China to resolve the matter, the judge said the Crown had not proven its case.<\/p>\n<p>Majcher\u2019s business, which focused on economic crime and asset recovery services, seemed to be pursuing \u201centirely lawful objectives,\u201d the judge said.<\/p>\n<p>The ruling found the Crown\u2019s evidence was \u201centirely circumstantial\u201d and it was \u201cjust too far a leap\u201d to conclude that Majcher committed any crimes.<\/p>\n<p>The Canadian Security intelligence Service wrote in its <a href=\"https:\/\/www.canada.ca\/content\/dam\/csis-scrs\/images\/2025\/public-report\/Public%20Report_EN_2025_DIGITAL.pdf\">May 1 annual report<\/a> that China stays certainly one of the \u201cpredominant perpetrators of foreign interference and espionage against Canada.\u201d<\/p>\n<p>But Prime Minister Mark Carney has deepened Canada\u2019s ties with Beijing since taking office, as
