The Sandiganbayan Fifth Division denied detained Senator Jose \u201cJinggoy\u201d P. Ejercito Estrada\u2019s request to attend the Senate impeachment trial of Vice President Sara Duterte-Carpio, ruling that his participation as a senator-judge was incompatible along with his status as a detention prisoner and didn’t constitute a compelling ground for temporary leave from detention.<\/p>\n
In a seven-page resolution promulgated on Thursday, penned by Associate Justice Maryann E. Corpus-Ma\u00f1alac, the anti-graft court denied for lack of merit Mr. Estrada\u2019s motion looking for permission to take part in the impeachment proceedings.<\/p>\n
Mr. Estrada argued that his attendance was needed since the Structure requires the concurrence of two-thirds of all senators to convict an impeachable officer and that his participation within the trial was a \u201chigh constitutional duty\u201d warranting temporary leave from detention.<\/p>\n
The Fifth Division rejected the argument, citing Supreme Court rulings in Trillanes IV v. Pimentel, Sr., People v. Maceda, and People v. Jalosjos, which held that public officials under detention may not perform the functions of their office unless released on bail or recognizance.<\/p>\n
The court said Mr. Estrada stays detained after not posting bail in his graft case and while his bid for bail within the non-bailable plunder case stays pending.<\/p>\n
It also ruled that his request couldn’t be considered an emergency or compelling temporary leave, noting that the Senate impeachment trial is scheduled three days every week over 92 trial days spanning 31 weeks.<\/p>\n
\u201cSuch a chronic and recurring arrangement cannot, by any stretch of the imagination, be considered an emergency or compelling temporary leave from detention,\u201d the court said.<\/p>\n
It added that allowing Mr. Estrada to attend the impeachment trial would \u201cvirtually make him a free man with all of the privileges appurtenant to his position\u201d and \u201cmake a mockery of the needs of preventive detention.\u201d<\/p>\n
The costs stem from alleged irregular allocations for Department of Public Works and Highways (DPWH) flood control projects, with the Ombudsman alleging Mr. Estrada received P573 million. \u2014 Mark Joseph M.
